How are Municipal Boundary Adjustments completed?
almost 5 years agoThe Municipal Act, 2001 provides the legislation for Municipal reorganizations, including municipal boundary adjustments. Sections 171 to 173 contain the legislative process which allows municipalities to complete restructuring in a timely and efficient manner. The process includes the following steps:
Municipalities develop a restructuring proposal describing details such as new boundaries, effective date, transition provisions and compensation.
The councils of the municipalities must give notice and hold at least one public meeting. It is not unusual for all involved municipalities to hold a joint public meeting. Public notice for the meetings is determined by each municipality according to its procedure by-laws. The meeting must be advertised in each municipality.
Municipalities are expected to consult with Indigenous communities to determine if the proposed changes might adversely affect Aboriginal or treaty rights (e.g. hunting or fishing) or Aboriginal interests.
Councils vote on the proposed restructuring proposal.
A locally developed restructuring proposal is implemented through a Minister’s order, at the Minister’s discretion.

almost 5 years agoA municipal boundary adjustment is a form of restructuring that municipalities can use to change their geographic borders. As a result of the boundary adjustment, land is transferred from one municipality to another. It is important to note that the ownership of the land does not change. What does change is the local government that is responsible for the lands that are transferred.Municipalities may wish to restructure in order to accommodate future growth, combine resources and build capacity, or simply realign a boundary to roads or buildings.
